Conditions d’utilisation

These terms explain what you get when you buy Handstand Kick Starter, how you can use it, and what we each commit to. We have tried to write them in plain English. Please read them before you buy, especially section 7 (Refunds) and section 8 (Health and safety).

1. Who we are

2. Scope and acceptance

2.1 These terms apply to every purchase of Handstand Kick Starter (the “Course”) and to every use of the online studio at studio.mariusgremaud.com (the “Studio”). “You” means the person who buys and uses the Course.

2.2 These terms are available on our website before you buy, and a link to them is shown at checkout. By ticking the acceptance box (or otherwise confirming your acceptance) and completing the payment, you accept these terms.

2.3 The contract for the Course is concluded when your payment is confirmed. You receive a confirmation and a receipt by email.

2.4 Payments are processed by Stripe through its “Sold through Link” service (see section 4). For the payment itself, the buyer terms of Link also apply. These terms govern the Course, its content and your use of the Studio.

2.5 The version of these terms that applies to you is the version in force on the date of your purchase. You can save or print this page at any time.

2.6 The Course is intended for people aged 16 or older. If you are between 16 and 18, you may only buy and use the Course with the consent of a parent or legal guardian, who accepts these terms on your behalf.

3. The course

3.1 Handstand Kick Starter is an online video course to learn the handstand. It includes a 28-day program organised in 4 practice modules (one per week), plus a Methodology module and a Philosophy module of 4 videos each (one video of each per week), with 24 video lessons in total and accompanying written notes, delivered through the Studio.

3.2 The Course aims to help you develop technique, strength, body awareness and a regular handstand practice. It is an educational and sports program. It is not individual coaching, it does not include personal feedback on your practice, and it is not medical, physiotherapy or rehabilitation advice.

3.3 We describe what the Course contains, not a specific result. Your progress depends on your starting level, your physical condition, how regularly and carefully you practise, and other individual factors. We do not guarantee that you will reach a free-standing handstand, or any other result, within 28 days or any other period.

3.4 The videos are streamed online only. They cannot be downloaded.

4. Price, taxes and payment

4.1 The price of the Course is CHF 149, a one-time payment. There is no subscription and no recurring charge.

4.2 The price shown at checkout is the final price you pay, including any VAT or sales tax that applies to your purchase. Depending on your location, the checkout may show the price in your local currency, converted from CHF.

4.3 Payment is made through Stripe’s secure checkout. The order is sold through Sold through Link, LLC (“Link”), an affiliate of Stripe, which acts as the reseller and merchant of record for the transaction. Your card statement will show a description starting with “LINK.COM*”. Receipts and invoices are sent to you by Link. We never see or store your full card details.

4.4 If a payment fails, is duplicated, or you believe you were charged the wrong amount, contact us at info@mariusgremaud.com or contact Link support. Duplicate or incorrect charges will be refunded.

4.5 We may change the price of the Course for future purchases. A price change never affects a purchase that has already been made.

5. Access to the course

5.1 After your payment is confirmed, a personal account is created for you in the Studio and you receive an email to set your password. You are normally given access within a few minutes. If you have not received this email within 24 hours (check your spam folder), contact us.

5.2 To use the Course you need an internet connection, an up-to-date web browser and a device able to play streaming video. Internet and device costs are your responsibility.

5.3 If you lose access to your account (forgotten password, changed email address, technical issue), use the “forgot password” link or contact us. We will help you regain access once we have reasonably confirmed that the account is yours.

5.4 We will not suspend or remove the access of a customer who has paid and complies with these terms, except as described in sections 6 and 16.

6. What “lifetime access” means

6.1 “Lifetime access” means that, after a single payment, you can use the Course for as long as we offer it in the Studio, with no time limit and no additional fee. It does not mean the lifetime of the buyer, and it is personal to you (see section 9).

6.2 We intend to keep the Course available for the long term. If we ever decide to permanently stop offering the Course, we will inform you by email at least 90 days in advance, so that you have time to complete the program and make the most of it before access ends.

6.3 We may move the Course to another platform or change how it is delivered. If we do, we will transfer your access at no cost to you.

7. Cancellation and refunds

7.1 Immediate access. The Course is digital content. You get full access to it right after payment.

7.2 14-day start guarantee. If, within 14 days of your purchase, you have completed fewer than 3 lessons and you feel the Course is not for you, write to us and we will refund you in full. This is a voluntary commercial guarantee, in addition to your legal rights.

7.3 After that. Because you receive full and immediate access to all the content, we do not otherwise offer refunds if you simply change your mind, do not use the Course, or are unhappy with your rate of progress.

7.4 Your legal rights remain. Sections 7.2 and 7.3 do not limit any right you have under mandatory law or under the Link buyer terms. In particular:

  • if you are a consumer in the European Union or the United Kingdom, you can withdraw from your purchase within 14 days of receiving access, as provided by the Link buyer terms. To do so, request a refund from Link support and give “withdrawal period” as the reason. If you live in another country whose law gives consumers a right of withdrawal, that right applies to you as well;
  • Link may grant refunds in certain cases under its own refund policy, for example within 60 days if you did not receive the content, if it is significantly not as described, or if a payment was not authorised or duplicated;
  • you are always entitled to a remedy if the Course is not delivered, cannot be accessed for reasons on our side, or does not match its description (see 7.5).

7.5 If something does not work. If you cannot access the Course, or a lesson is missing, defective or significantly different from its description, contact us. We will first try to fix the problem within a reasonable time. If we cannot, you are entitled to a full or partial refund, as appropriate.

7.6 How to ask. Write to info@mariusgremaud.com with your name, the email address used for the purchase and a short description of the issue. Refunds are made to the original payment method. We encourage you to contact us before opening a dispute with your bank: most problems can be solved quickly. This does not affect your right to contact your bank.

8. Health and safety

8.1 Handstand practice involves being upside down, carrying weight on your hands, wrists and shoulders, and a real risk of falling. It can lead to injury.

8.2 Before you start, honestly assess your level and physical condition. Consult a doctor or another qualified health professional before starting if you have, or think you may have, any medical condition, injury, pain (particularly in the wrists, shoulders, neck, back or head), high blood pressure, glaucoma or other eye condition, a heart condition, if you are pregnant, or if you are unsure whether the Course is suitable for you.

8.3 Practise in a safe environment: a clear space with no furniture or objects around you, a stable, non-slippery floor, and a solid wall when the exercise requires it. Always warm up as shown in the Course, follow the progression, and learn how to exit a handstand safely before attempting harder exercises. If needed, use additional safety measures or practise with an experienced person nearby.

8.4 Stop immediately if you feel pain, dizziness, numbness, shortness of breath or any other worrying symptom, and seek medical advice if it persists.

8.5 The videos show general instructions. We cannot see you, correct you individually or adapt the exercises to your personal situation. You decide which exercises to do, how and when, and you practise under your own responsibility.

8.6 Nothing in the Course is a promise that the practice is free of risk. Our liability is governed by section 15.

9. Your account and permitted use

9.1 Your account is personal and non-transferable. Keep your password confidential and do not share your login details. You are responsible for activity on your account unless it results from a security failure on our side.

9.2 You may use the Course for your own personal, non-commercial learning and practice. Without our written permission, you may not:

  • share your account or give other people access to the Course;
  • show the videos to a group, a class or clients, or use the Course to teach others for money;
  • resell, rent, give away or otherwise transfer your access.

9.3 If you are a coach, teacher, gym or studio and want to use the Course with others, contact us for a licence.

9.4 To protect your account and the Course, we may take reasonable security measures, such as limiting the number of simultaneous sessions or detecting unusual activity.

10. Intellectual property

10.1 The videos, texts, images, program structure, design and other materials of the Course, as well as the names and logos used for it, belong to us or our licensors and are protected by copyright and other intellectual property rights, to the extent that such rights exist.

10.2 When you buy the Course, we grant you a personal, limited, non-exclusive and non-transferable licence to access and use it for your own learning, in accordance with these terms. All other rights are reserved.

10.3 You may not copy, download, record, screen-capture, republish, distribute, sell or make available any part of the Course, or use it to create a competing product, without our written permission.

10.4 Handstand exercises and general training principles are not, as such, owned by anyone. Nothing in these terms prevents you from practising what you learn, or limits any use that the law expressly allows (for example private use or quotation within legal limits).

10.5 If you see the Course being shared or sold without our permission, please let us know at info@mariusgremaud.com.

11. Prohibited conduct

You must not: try to access accounts or parts of the Studio that are not yours; bypass or disable access controls or copy protection; use bots or scripts to extract content; interfere with the security or operation of the Studio; or use the Studio for any unlawful purpose.

12. Availability and changes

12.1 We aim to keep the Studio available at all times, but it may occasionally be unavailable because of maintenance, updates, or technical problems on our side or at our hosting and video providers. We will try to schedule maintenance at quiet times and to fix problems within a reasonable time.

12.2 If you notice a problem, please report it to info@mariusgremaud.com.

12.3 We may update and improve the Course (for example, re-record a video or add content). We will not remove or change the content in a way that significantly reduces what you bought, except where necessary for legal, safety or technical reasons. If such a change significantly reduces the Course, you may ask for an appropriate remedy under section 7.5.

12.4 If the Studio is unavailable for a long period for reasons attributable to us, we will extend or restore your access and, where appropriate, offer another remedy.

13. Third-party providers

We use third-party providers to sell and run the Course, in particular:

  • Stripe and Link (Sold through Link, LLC): checkout, payment, receipts, tax handling, fraud prevention and payment support;
  • Automattic (Jetpack): security and site tools for the Studio;
  • Infomaniak (Switzerland): hosting of mariusgremaud.com and of the Studio, sending of course emails, video hosting and streaming;
  • Zapier: automatic creation of your Studio account after payment;
  • Meta (Meta Pixel and Conversions API) and Google (Analytics, Tag Manager): measuring visits and the effectiveness of our advertising on mariusgremaud.com, subject to your cookie choices;
  • website tools such as Elementor.

Each provider is responsible for its own services under its own terms and privacy policy. We remain responsible to you for providing the Course as described in these terms. More details on how data is shared with these providers are in our Politique de confidentialité.

14. Personal data

We process the personal data needed to sell you the Course, give you access, send you course-related emails (such as access details, progress and reminder emails, which you can unsubscribe from) and answer your questions. How we do this, and your rights, are explained in our Politique de confidentialité. We only send you marketing messages if the law allows it or you have agreed to receive them. Accepting these terms is not a consent to any other use of your data.

15. Liability

15.1 We are liable for damage caused intentionally or through gross negligence, and for any liability that cannot be excluded or limited under applicable law (including, where applicable, liability for death or personal injury caused by our negligence).

15.2 To the extent permitted by law, we are not liable for slight negligence, and in particular for:

  • injuries or damage resulting from how you practise, including not following the instructions and safety advice in the Course and in section 8;
  • temporary unavailability of the Studio, or problems caused by your device, internet connection or third-party services outside our control;
  • indirect or consequential loss, such as loss of income or data.

15.3 Where our liability for slight negligence cannot be excluded, it is limited to the price you paid for the Course, to the extent permitted by law.

15.4 Nothing in these terms limits the rights you have as a consumer under mandatory law, including the statutory rights concerning the conformity of digital content.

16. Complaints, suspension and termination

16.1 If you are dissatisfied, contact us first at info@mariusgremaud.com. We will look at your complaint and reply as quickly as possible.

16.2 We may suspend your access, after contacting you where reasonably possible, if we have serious grounds to believe that you are sharing your account, distributing the content, committing fraud or otherwise seriously breaching these terms. We will explain why and give you an opportunity to respond. If the breach is confirmed and serious, or continues after a warning, we may close your account. In that case, no refund is due except where required by law.

16.3 You may close your account at any time by writing to us. Closing your account ends your access; it does not by itself give a right to a refund.

16.4 Sections 10, 15, 17 and 19 continue to apply after the end of the contract.

17. Governing law and disputes

17.1 These terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

17.2 If you are a consumer living outside Switzerland, this choice of law does not deprive you of the protection of the mandatory consumer protection rules of the country where you live, where those rules apply.

17.3 We will always try to resolve any disagreement amicably first. Write to us and we will look for a fair solution together.

17.4 Subject to mandatory rules, the courts of the Canton of Fribourg, Switzerland, have jurisdiction. If you are a consumer, you may also bring proceedings in the courts of your place of residence, and proceedings against you as a consumer may only be brought where the applicable law allows, in particular in the courts of your place of residence.

18. Changes to these terms

We may update these terms, for example to reflect a change in the law or in the Course. The new version applies to purchases made after its publication. For existing customers, a change that is to your disadvantage only applies if you have been informed in advance by email and it is permitted by law; it never removes rights you have already acquired, such as your access to content already purchased.

19. General provisions

19.1 If any provision of these terms is found invalid, the other provisions remain in force, and the invalid provision is replaced by a valid one that comes as close as possible to its purpose.

19.2 If we do not enforce a right immediately, this does not mean that we waive it.

19.3 These terms, together with the information shown on the sales page and at checkout, form the entire agreement between you and us about the Course.

19.4 These terms are written in English. If we provide a translation, the English version prevails.
